Terms of Service

1. Acceptance of Terms

By accessing and using the website PetruAmortoae.com (the “Website”) and engaging the services of Petru Amortoae (the “Designer”), you (“Client”) agree to be bound by these Terms and Conditions (“T&Cs”). If you do not agree with these T&Cs, you should not use the Website or engage the Designer’s services.

2. Services Offered

The Designer offers web design, web development, SEO optimization, server management, website maintenance, and related services (the “Services”) as described on the Website. The specific Services to be provided to the Client will be outlined in a separate project proposal or agreement (the “Agreement”).

3. Project Agreement

Each project will be governed by an Agreement that outlines the scope of work, deliverables, timelines, payment terms, and other specific details relevant to the project. The Agreement will be considered an integral part of these T&Cs.

4. Payment Terms

• Fees for Services will be as specified in the Agreement.

• Payment schedules will be outlined in the Agreement (e.g., initial deposit, milestones, final payment).

• Late payments may be subject to interest charges as specified in the Agreement.

• The Designer reserves the right to suspend or terminate Services in the event of non-payment.

5. Client Responsibilities

The Client is responsible for:

• Providing accurate and timely information, content, and materials required for the project.

• Reviewing and approving deliverables within agreed-upon timelines.

• Providing timely feedback and communicating any concerns or changes to the project scope.

• Obtaining all necessary licenses and permissions for content provided to the Designer.

6. Intellectual Property

• The Client retains ownership of all content provided to the Designer.

• The Designer retains ownership of all design elements, code, and other intellectual property created by the Designer prior to full payment by the Client.

• Upon full payment, the Client will receive a license to use the final website design and related materials as specified in the Agreement.

• The Designer retains the right to display the completed project in their portfolio and marketing materials, unless otherwise agreed upon in writing.

7. Confidentiality

The Designer will treat all Client information as confidential and will not disclose it to third parties without the Client’s consent, except as required by law.

8. Revisions and Changes

The Agreement will specify the number of revisions included in the project scope. Additional revisions or changes requested by the Client may be subject to additional fees.

9. Project Timelines

The Designer will make reasonable efforts to adhere to project timelines outlined in the Agreement. However, timelines may be affected by factors outside of the Designer’s control, such as Client delays, technical issues, or unforeseen circumstances.

10. Termination

Either party may terminate the Agreement with written notice if the other party breaches the Agreement. In the event of termination by the Client, the Client will be responsible for paying for all Services provided up to the date of termination.

11. Limitation of Liability

The Designer’s liability for any claim arising out of or in connection with these T&Cs or the Services provided will be limited to the amount paid by the Client for the Services. The Designer will not be liable for any indirect, incidental, or consequential damages.

12. Disclaimer of Warranty

The Services are provided “as is” without any warranty, express or implied. The Designer does not warrant that the Website will be error-free or uninterrupted.

13. Governing Law

These T&Cs will be governed by and construed in accordance with the laws of Romania.

14. Changes to Terms and Conditions

The Designer reserves the right to modify these T&Cs at any time. Changes will be effective upon posting on the Website.

15. Entire Agreement

These T&Cs, together with the Agreement, constitute the entire agreement between the parties and supersede all prior or contemporaneous communications and proposals, whether oral or written.
